Our Terms of Uses govern the use of our Service and serves as an agreement that operates between You and Our Company. By accessing or using our Service You agree to be bound by these Terms of Use. If You disagree with any part of our Terms of Uses, You can choose not to access our service. You agree that when you click on the accept button notification on our Terms of Use you are deemed to have agreed to our terms and condition. Our Terms of Use set out your rights and obligations when you access or use our Service. These Terms of Use apply to all visitors, users and others who access or use the Service.
"we", "us" or "our" in this privacy policy, refers to Credenz Technologies Limited. The use of the pronoun ‘’You’’ or ‘’Your’’ refers to any user of our services.
Definitions
Customer: a user who has placed an order to rent or purchase a property, requested a facility to rent or purchase a property, or is saving towards renting or purchasing a property through the Credenz mobile application or website.
Merchant: a property owner or a registered/licensed agent who has signed up with Credenz to rent out or sell a property.
Property: any house, land or other building with a legal title listed on the Credenz mobile application or website by a Merchant
Service Channels: Credenz Mobile Application, Credenz website.
User: refers to a customer or a merchant of Credenz.
Transaction: sale or rent or save for a property.
Order: placing a request to buy or rent or save towards a property (in the case of a customer) or placing a request to sell or rent a property (in the case of a Merchant).
Capacity Statement
You may not make use of our services if you are under the legal age to enter into a contract with Credenz. You represent that you are over the age of 18 when you make use of our services.
Your Credenz Account
When You create an account with Credenz, You warrant that you will provide Us with information that is accurate, complete, current, and update us of any changes to Your information. Failure to comply with this requirement constitutes a breach of Our Terms, which may result in suspension or termination of Your account on Our Service.
Credenz ensures the safety of personal data of users. However, You are responsible for safeguarding the password that You use to access Our Service. You agree not to handle your password carelessly or disclose your password to any third party. You agree to notify Us immediately You become aware of any breach of security or unauthorized use of Your account.
You agree not to make use of another person’s name as a username or to make use of a name or trademark that is subject to any rights of another person or entity other than You without obtaining permission to do so.
Credenz Transaction Policy
By signing up as a Customer or Merchant on our Service channels, You warrant that You are legally capable of entering into a binding contract with us.
Warranty on information
If You wish to use our Service as a Customer or Merchant, You will be asked to give information relevant to Your category, such as, Your name, Your email, Your phone number, Bank Verification Number (BVN), Debit/Credit card number, the expiration date of Your card, Bank account details, etc.
You represent and warrant that: (i) The bank details belongs to you (ii) You have the legal right to use such debit or credit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.
You also give us the right to provide the information to payment processing third parties, due diligence check partners for purposes of facilitating the completion of the transaction.
Transaction Cancellation
Credenz reserves the right to refuse or cancel Your transaction at any time for certain reasons including but not limited to:
Availability and Inaccuracies on our channels
We strive to constantly update Our offerings on the Service channels. The Properties available on Our Service channels may be mispriced, described inaccurately, or unavailable, and We may suffer delays in updating information.
We cannot and do not guarantee the accuracy of any information, including prices, images of properties, specifications, and availability. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Payments
Payment can be made through Paystack payment method we have made available, using Payment cards (credit cards or debit cards) which are subject to validation checks and authorization by Your card issuer and Paystack. If we do not receive the required authorization, We will not be liable for any delay of your transaction nor be liable for any error during your transaction.
Intellectual property
We reserve the exclusive right to our intellectual property right on our Service channels. We do not permit the copying, downloading, transmission and modification of our trademarks and service marks (registered and unregistered) displayed on our channels. We further reserve the right to our copyright in our website and mobile application design and of contents displayed on our webpage and on our mobile app. Any use of intellectual property right without prior written authorization and acknowledgement constitutes infringement or passing-off in law and violator will be liable to legal prosecution. You agree to grant Our Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit Your Feedback to us without restriction.
Indemnity
You hereby undertake to defend, indemnify and hold harmless Credenz, Our directors, officers, employees, agents, successors or assigns from and against any and all claims, losses, damages, liabilities, costs and expenses (including but not limited to reasonable legal fees) arising from breach of this Terms of Use. We shall not be liable for any act or omission by any third party.

Our website may contain links to third-party web sites or services that are not owned or controlled by us. We do not assume responsibility for the content, privacy policies, or practices of any third-party web sites or services. You agree that we shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of such web sites or services.
Limitation of Liability
WE ARE DEDICATED TO ENSURING THE SMOOTH OPERATION OF OUR SERVICE CHANNELS. HOWEVER, CREDENZ WILL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INFORMATION, FOR PERSONAL INJURY, LOSS OF PRIVACY ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE CHANNELS, THIRD-PARTY SOFTWARE AND/OR THIRD-PARTY HARDWARE USED WITH THE SERVICE, OR OTHERWISE IN CONNECTION WITH ANY PROVISION OF THIS TERMS), EVEN IF CREDENZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR, THE ENTIRE LIABILITY OF CREDENZ UNDER ANY PROVISION OF THIS TERM IS LIMITED TO THE LESSER OF THE AMOUNT ACTUALLY PAID BY YOU THROUGH THE SERVICE WITHIN THE LAST 12 (TWELVE) M0NTHS OF USING THE SERVICE OR THE SUM OF NGN5,000 (FIVE THOUSAND NAIRA) ONLY
CREDENZ WOULD NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, FOR PERSONAL INJURY, LOSS OF PRIVACY) ARISING OUT OF OR IN ANY WAY RELATED TO TRANSACTIONS BETWEEN CUSTOMERS AND MERCHANTS ON THIS PLATFORM.

OUR SERVICE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ANY WARRANTIES, WITH RESPECT TO MERCHANTABILITY, FITNESS FOR PURPOSE, TITLE OF PROPERTIES ON OUR SERVICE CHANNELS.
WE PROVIDE NO UNDERTAKING AND MAKE NO REPRESENTATION OF ANY KIND THAT THE SERVICE CHANNELS WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS OR SERVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS OR BE ERROR FREE OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.
WE PROVIDE NO WARRANTY THAT THE SERVICE CHANNELS WILL BE UNINTERRUPTED OR ERROR-FREE; THAT INFORMATION ON THE CHANNELS WILL BE ACCURATE, CURRENT AND RELIABLE, THAT THE SERVICE, ITS SERVERS, THE CONTENT, OR E-MAILS SENT FROM OR ON OUR BEHALF ARE FREE OF VIRUSES, SCRIPTS, TROJAN HORSES, WORMS, MALWARE, TIMEBOMBS OR OTHER HARMFUL COMPONENTS.
Changes to Our Terms of Use
We have the right to change or replace these Terms at any moment, at Our sole discretion. We will make reasonable attempts to offer at least 30 days' notice before any new terms take effect if the adjustment is fundamental. What constitutes a fundamental change will be determined solely by us.
You agree to be bound by the amended terms if you continue to access or use Our Service after those adjustments go into effect. Please discontinue using the website and the Service if you do not agree to the amended terms in whole or in part.
Your obligation towards Credenz
Governing Law and Dispute Resolution
This contract shall be governed, interpreted, and enforced under the laws of the Federal Republic of Nigeria.
Where any dispute arising, from this Agreement, regarding the interpretation of this term of use, the rights, duties, and liabilities of the Parties governed by these terms both parties will attempt to resolve this dispute through negotiation within 30 (thirty) days.
Where the dispute cannot be amicably resolved by the Parties within 30 (thirty) days such dispute shall be referred to arbitration in accordance with and subject to the provisions of the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria 2004. Each party shall bear the cost of the Arbitration.
Termination
If you violate any provision of Our Terms, your right to access Our service channels will be automatically terminated. We shall have the right to terminate your account on Our Service channels or suspend or terminate, suspend, or discontinue your access to the Service at any time, with or without notice. We shall not be liable for any change to Our Service or any suspension or termination of your access to or use of the Service. You have the right to cancel your account at any time by discontinuing the use of our services. Notwithstanding the cancellation of your account your obligation to pay any outstanding fees relating to the use of Our Service incurred prior to termination remains enforceable.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified and interpreted to achieve the provision's objectives to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.
Waiver
Unless otherwise provided herein, a party's failure to exercise a right or require performance of an obligation under these Terms shall not affect that party's capacity to exercise such right or require such performance at any time thereafter, nor shall a waiver of a breach constitute a waiver of any subsequent breach.
Consent to Electronic Communications
You agree to receive specific electronic communications from us by using the Service. You agree that any notifications, agreements, disclosures, or other information sent to you electronically will fulfill any legal communication requirements, including the need that they be in writing. Please read our Privacy Policy to understand more about your options when it comes to our online communications practices.
No Estate Management Advice
We act as a technology platform to connect you with Merchants and help fund your rental needs. Credenz is not itself a real estate agency or an estate management agency. The Merchants are solely responsible for providing you offers for available housing for rent or property for sale. We do not control or interfere with the sale or rent by Merchants, each of whom is responsible for the warranties and representations he or she provides regarding the availability, title to property and fitness for habitation of property. By accepting these Terms and by using our Service, you are entering into a tenant- landlord or seller- buyer relationship solely with the merchant and not with Credenz. The information about property availability and inspection provided by Credenz through the Service channels is for general information purposes only. None of the Credenz’s Materials should be considered estate management advice or an endorsement, representation, or warranty as to title, availability or fitness for habitation of any property.
